Legal doesn't make it a good business decision. Non-refundable anything gives the tenant no incentive to comply. --70.19.xxx.xxx

A better idea is an increased refundable security deposit (your usual security deposit plus $400, for instance) plus a monthly 'pet fee' of $25 or so. --71.63.xx.xxx

I agree on the refundable part... If they've already shelled out $500 that they'll never see again for pet damage, what's their incentive to prevent it? Might as well get their money's worth. --162.114.xx.xx
