State Specific Question About: INDIANA (IN)

I had to evict my last tenant and got the judgement. After the judgement was granted, the ex-tenant said she would send us $100 a month, but I have a hard time believing her (from past lies on payments promised). So I have questions on the collecting. How do you add the eviction record to all 3 credit bureaus? How do you go about garnishing wages? Is it going to take another court hearing or does it just take some filing of paperwork?

You might give it one more try with her, let her know that you're *this* close to reporting the judgment to the credit bureaus, but will hold off if she makes her first payment within 7 days, and continue holding reporting until the FIRST time she is late with a payment, see if that helps get her moving... just a thought.

(I think at this point garnishing wages is just a matter of sending the paperwork to her employer, and that would be good to get onto fast, before she quits... but that's just an educated guess for my state, you need solid answers for yours.) --24.21.xx.xxx

BETTER INFORMATION from the first page I found with quick google on "indiana how to garnish wages." So much for my optimism. More complicated.

15. Indiana Wage Garnishment

The maximum part of an individual's aggregate disposable earnings for the workweek that is subject to garnishment in Indiana is the lesser of:

1. 25% of the disposable earnings; or

2. The amount of the disposable earnings that exceed 30 times the federal minimum hourly wage.

Note: A wage garnishment can be obtained after interrogatories are served and completed and after a motion for proceeding supplemental is heard. Garnishments filed in up Claims Court cases require a filing fee of approximately $15.00. Indiana now recognizes Voluntary Wage Assignments, which are to be signed by the debtor and the creditor, or the creditor's attorney, and submitted to the employer. --24.21.xx.xxx

Register your judgment in the county where the property is located that they rented, and also where they are living now (if you know). It worked for me, so when the fellow sold a new house he had bought, I was one of the people listed on a judgment (as well as the IRS and state taxes due) that he owed. And I got paid over $5,000 and interest---it was a few years in coming, but I got it. --209.77.xxx.xx

The eviction will make it's way on to all three credit reports gradually. Your first goal is to get that money now. Garnishment may have some procedure with it but you should go immediately to the courthouse and get the papers to file garnishment and inquire there about procedure. You may have to request a fi fa or some other additional document that is automatically granted. Garnishment is nearly automatic. Oh yes, they'll be a court hearing but it is only a chance to make sure that the garnishment is valid (not a re-arguing of your tenant-landlord case). Can't emphasize how important time is in this equation. Get the garnishment filed before the lady runs off to another job. You'll lose track of her otherwise and she doesn't care about bad credit or she would've paid as agreed. --74.166.xx.xxx
