State Specific Question About: INDIANA (IN)

I moved from Fremont, IN. back to Indianapolis Dec. 2006. My friend and ex-coworker wanted to buy my house but couldn't get financed at that time, so we did a rent to buy contract. In March, I heard that she was moving in with her boyfriend in another house. I contacted her by phone on March 23, 2008, and she told me that her boyfriend had been looking to purchase a house because they have been told on several occasions that my home is under foreclosure, which it isn't. I even gave her the financial institute information and loan number to verify. She stated that she wouldn't just leave, that she'd give me notice. When I didn't receive April's payment by the 4th, I tried to call her at work several times, because I didn't have her new number. I was given the runaround and she never returned my calls. Today (april 9) I received a certified letter stating that she couldn't get financed and didn't want to rent the house, so she was leaving on April 6, 2008. The date the letter was mailed was April 7, 2008. I am curious as to what I can charge her for. I realize I can charge her for April's payment, since she was there for at least part of the month. I am curious if I can charge her for any more months, since she didn't give a 30 day notice. Also, can I charge her for the new locks I'm going to have to install? The gas for my car for having to make the trip to investigate the house for damages? And can I charge her for any cleaning or repairs I have to make to the house so that I can get it ready to sell? Basically I would just like to no what my legal options are. Thank you --64.12.xxx.xx

Was she on a lease or month-to-month? What does your rental agreement say about all these things? Did you receive option consideration money for the rent to own contract? Maybe you can keep that as liquidated damages, at lease for the lease option side of the deal.

I would at least charge her for April. The rest largely depends on the wording of your rental agreement. Is she collectable? Maybe you should just be happy that she is gone without having to evict her. Is she gone? Your best bet is to try to re-rent immediately and cut your losses. If you are unable to re-rent after months and months of REALLY trying, you may have some legal recourse with her IF you had a lease.

No, you can't charge her for the locks unless it's in your rental agreement. No you can't charge her for travel, but you can write this off on your tax return. Yes you can charge for cleaning/repair, if these are in excess of "normal wear and tear" which cannot be charged for. --24.18.xx.xxx
