State Specific Question About: KENTUCKY (KY)

I am curious. Can you discriminate on move in dates? For example: I want someone to rent my place within the next 4-5 weeks. Can I prevent applications for people who want to rent in 6 weeks, 3 months, etc?

It has to be legal to screen out an applicant if their time frame is not reasonable. Also it is not a protected class its my understanding.

yes you can. or just tell them that you accept the first applicant that meets your screening criteria and has the move in money. You will continue to take applications until someone meets all this including the money. So - they may get approved but without the money they dont get the unit and you keep on showing

Typically they will screen themselves out based on not having the money and not wanting to pay the application fee --66.190.xxx.xx

I know that its not necessary to cater to their time frame but was wondering if their is a specified window for which one must take applications. IE. 1-2 months etc. It appears that there is no such law, but it also seems to me that if that time frame were 1-2 weeks or less then it almost seems like something discriminatory could be in question. --216.248.xx.xxx

let them screen out themselves. You could tell them that it is your opinion that the place will be rented in 2 weeks based on the market conditions and number of calls. If they want to pay the application fee then let them.

On our application it states that the applicant must be willing to take possession no later than two weeks from date of application approval or when unit is ready. We refuse to hold units for longer than that. When someone wants us to we tell them to please check back when they are ready to move and if the unit is still available they can have it otherwise we are going to continue to market and accept applications.

There is no law that I am aware of that says you have to hold a unit for an indefinate period of time once an applicant is approved. --66.60.xxx.xxx

move in date is the date the unit is available to rent. If it is available to rent today and someone that qualifies to rent today then they go ahead of someone that qualifies but can't rent till tomorrow.

1) Don't take any holding fee/deposit until AFTER you have fully screened and approved an applicant.

2) NEGOTIATE the holding period. I DO want prospects to be good and give their current LL 30 days notice. BUT I do NOT hold for a full month. I typically negotiate a date somewhere in the middle..I prefer two weeks but will stretch to three for the right candidate. --207.200.xxx.xx

3) I leave the ad (but do not respost a new one) up and put in it that we have a tentative contract effective XX/XX/XX but are still showing the place and accepting "backup" interest info/applications (but not processing them). SOME will still come and look at your place which is great because you can build an interest list. Just have to be honest with them AND NOT take an application "fee" per CA law. --207.200.xxx.xx
