State Specific Question About: INDIANA (IN)
Friday, I received an e-mail from a lady wanting to rent one of my rental homes and she was moving from Florida and her brother lives down the street. I sent her an application via e-mail and she e-mailed it back within minutes. I told her I would need a signed application and she could fax it to me at work, but I wouldn't receive it until Monday. On Saturday, I received another e-mail from someone wanting to rent the same house and Sunday they gave me their application. I am accepting their application, how do I let the lady in Florida know I've rented out the place in a nice way. She wouldn't of qualified anyway because of income (didn't meet or exceed 3x's monthly rent). Do I tell her she didn't get approved or do I tell her I've rented out the home already? --68.77.xx.xx |

I would tell her that you are legally obligated to accept the first application that meets your written criteria. The first step in that written criteria is a SIGNED application. Tell her that someone submitted an application straight away. Tell her you wished you had another home for her, but that you did not.

If I've learned anything about the app process from this board it's the less said, the better.
First, there's about an 80% chance you'll never get the signed app faxed to the office. Play the odds. If she does fax it in, I'd give her a call and say unfortunately someone else submitted a completed application on Sunday and you're legally required to rent to the first qualified applicant. Going back to the big lesson from this board, do not make it a dialogue or a debate, finish your statement with "Sorry. Good luck in your search!" and get off the phone.
A side note is that if you accepted a app today and rented it today, you didn't do very much screening! Hard to check all that information and wait for those past reference callbacks on a Sunday afternoon. Screen hard, don't have regrets in the months to come! --68.8.xxx.xxx |

I would not say one word until she faxes an application. No fax then no reply. If she does then a simple thank you for your application and that it is already rented. --64.12.xxx.xxx |
