State Specific Question About: WASHINGTON (WA)

I may have to break a one year lease on a house I rent in Olympia Washington. I have a $600 security and cleaning deposit. If I break the lease do I forfeit my deposit?

Yes, no only do you "forfeit" your deposit, but you are legally responsible for full monies owed for the term of the lease(AKA you may be taken to court). Read your lease for details. --67.176.xx.xxx

To break a lease, which is a contract, you will have to pay. You should talk to your LL and offer perhaps 2 months rent as consideration for allowing you to break the lease. Does your lease document address the issue of early termination?

Give the LL as much notice as possible, and allow them to put it on the market to re-lease ASAP. Assist in the effort to get a new tenant in there by keeping it immaculately clean. --76.97.xx.xx

It's actually not cut and dried.

The landlord is technically out the full amount of rent for the remainder of the lease, as Drew said. In addition, you are responsible for reasonable costs associated with the unit being back on the market, such as advertising and showing costs.

But many leases have a lease break penalty, which takes precedence over the remainder costs. Read your lease.

As Laura says, the landlord's main concern will be to get the unit rerented and cooperating with him or her will help tremendously. --71.218.xx.xx

Greg, just to clarify what StevenColorado is saying. The money the landlord is out, is the money you owe the landlord, unless your lease states otherwise. If you signed a one-year contract, that is what you are on the hook for. It doesn't stop at your security deposit. If the landlord is able to re-rent the house right after you leave, that will decrease the amount you are liable for.

If you have to break the lease, make sure you stay in communication with the landlord throughout the process. You want your landlord to be able to rent that house out as soon as possible. Keep it very clean and let the landlord show it while you are still living there. The more you work with the landlord, the better your chances of staying out of court. --66.17.xxx.xxx
