State Specific Question About: KENTUCKY (KY)
Tenant has not paid rent, and will not answer door or phone. Received information that electric was turned off. Also received notice from another tenant that their was a problem with smell. Gave 48 hours notice to an answering machine that we would check apartment. Went in and no electric, refrigerator and freezer was full, that will be a problem. I would like to say that its a good thing that the smell is just a smell......had me worried.
Tenant could have vacated, in the hospital, maybe call their emergency contact if they haven't been around in a while. If they are still there and just not paying bills I would file for eviction for non payment of rent.

It's time to consult with the emergency contact person from this tenant's rental application as well as their place of employment. Hopefully they might know what's going on.
Have these people lived there long?
Have they ever had a problem paying rent on time?
Was the smell from stuff in the refrigerator?
Does your rental agreement address any of this?
I would post notice on their door as well as mail written notice to the tenant about the lack of power & rotten food. Get written confirmation of power shut off. Bring a witness when you photograph & clean out refrigerator.
Don't wait for the notice to be delivered. You need to get the refer cleaned out and deodorized ASAP before it gets any worse.
Is there any chance of any pipes freezing?

If I went in in response to another tenant's complaint and found no electric, but a refrigerator full of smelly, rotting food, I would have thrown the rotting food away in order to abate the smell for the existing tenant. Complaint from your existing tenant warrants it. Since you have received this complaint from the existing tenant, you may want to check on the offending place more frequently to ensure that the property is secure. You may need to enter to do furnace checks, checks for water leaks, etc.
Landlords generally do not have to give notice to enter their property when they believe there is an imminent emergengy or an immediate danger. A bad smell could be from the decomposing body of a deceased tenant and would usually be considered justifiable cause for entering a property without giving statutory (24 or 48 hrs) notice, though you should knock vigorously and call out your intentions loudly when entering. --64.12.xxx.xxx |

It look like to me that your tenants have at least technically abandoned your rental. Look into your state laws regarding abandonment. Abandonment would allow you to go in and take immediate repossession of your property to safe yourself from further possible damages. Lock the doors, store their possessions, and rerent as soon as possible. If they return give them back their possessions and if they don't return within the number of days allowed by your state then sell or trash their possessions. --65.6.xx.xxx |
