State Specific Question About: HAWAII (HI)

A lady with fatigue syndrom Leased my rental for six months, going back to CA. The last month rolled around, I put my rental in the classified news the second week into the mo. I got a lot of calls on it, told her I would be showing the place in 3-4 days. At first she said OK then she called me up and said she was ill and if I would wait another week or toward the last week of the mo. as she was then packing, giving excusses for me not to show it, The last day of the mo. she stayed in a Hotel, she had a cleaning person coming in that day, had the carpet shampoo days before? Well, the cleaning lady,only cleaned the refer and two windows. I was shocked!!! Custom tile in Kitchen cracked in six places, grout around bath tub, sinks, counter tops, full of mold,a hole in the bath tub all the way through, she must of fell into the walls, I could see where someone plastered, nail wholes everywhere, filthy toilet (I replaced it with a new one) broke the kitchen fixture and replaced it with some ol funky one. I was sick! It took almost two weeks to over haul...She was on so much medication most of the time, It was hard to understand her, and she slept a lot! I'm worried about her, actually. But she trashed the place and I want to know if I can charge her for the ad in the paper, the fact that it was so dirty and to embarrased to show the place. If I can charge her rent for the two weeks or even the whole month cause its not rented as of yet! And the custom tile work done in the kitchen, probably $1000. and extensive cleaning-how much? Where do I begin trying to itemise? --207.200.xxx.xxx

Not sure about the law in Hawaii, but in Missouri you'd have to take her to small claims court to sue for any damages to the unit not covered by the deposit. I don't think you'll get anything for the ad unless you have some sort of proof (photos, recorded phone conversations, video) of her refusing to allow you show the place. If she was just messy, then she should have been evicted for failure to follow the rules and regulations of her lease agreement (if you had some stating that apartment must be kept clean for showing). If you are not regularly inspecting your units for proper cleanliness, start doing so now. Most folks here go in every 90 or 180 days. Call and give 24 hours notice (or written if required by law) and GO IN. If a tenant refuses to admit you, evict, evict, evict...there is something seriously wrong and you do not want to find out later that the person was a drug dealer/manufacturer.
