State Specific Question About: KANSAS (KS)

We have a move out notice from tenant with us to collect the keys today at 6pm. I suspect that the tenant will be a no show. The utilities have already been shut off and are already back in my name (we have revert to owner on utilities). I drove by the property a couple of hours ago. No one is there. I could still see furniture in the there and kids toys in the yard. Can we change the locks today at 6pm per the signed move out notice from the tenant even if they still have crap in there?

This is a gray area and you will have to make this decision based on your gut feeling if you think they are done. I do this often because I know they're not coming back and so far (knock on wood) have always been right. I am in Topeka.

They are on a month to month with the first of the month being the beginning of the rent paying period.

They already didn't give us a 30day notice. They gave us notice on the 25th that they would be out by 29th. He shut off the utilities.

So what option are we left with, if he doesn't show up to give us keys???

The m-to-m agreement gives a 3day grace period. So normally I would go over on the 4th to post a 3day pay or quit notice. Is that our only option and then to go through with an eviction because he didn't show up to give us the keys???

I can't remember what the KS rules for abandonment are.

To me, it sounds like they are gone. I would do what tim [AR] said. I would go in with a camera or a witness, survey for abandonment, store anything valuable for a while, and change the locks - IF you feel that they have moved out. If they gave you 4 days notice, I doubt they were lying. They already had their new plans made.

I had this happen once. The tenant left a bunch of garbage and no keys! But I went inside the apartment and kicked around some of the garbage on the floor, and sure enough, there was a key. Most of these deadbeat-type tenants live their life fast and furious, and they don't have time to tie up all loose ends. Don't read too much into it. They are gone.

I had a similar situation. No notice and junk in my case, just an empty building and the utilities back in my name. The keys were on a shelf. Wait until after the tenancy has officially ended, (After 6:00 pm) enter and go about your business of prepping for the showing and next tenants.

This is not an uncommon thing.

Take lots of photos of the junk and if it looks to have any value at all, store it for awhile (obey your states laws). Charge against the SD appropriately for the added time to clean and for the costs of deposing of, or storing their trash.
