State Specific Question About: KANSAS (KS)

The electric company called me today about one of our properties. Said the tenant was requesting service at another address and if I knew anything about that. I said no. So I sent an email to our tenant asking if he was planning on moving and if so when, and if he wasn't he had better call the electric company to report fraud. Didn't hear back from him.

So I sent my husband over there with a move out notice that I wrote for the tenant to date and sign so it would show when we would have procession back of the property. My concern was that we would have a clean paper trail and not have to do an eviction on an empty property.

My husband gets over there and asks if they are moving and the tenant says yes and he sent me an email at the end of January stating that the last day of tenancy would be 2/29/08. He is on a month to month agreement with a 30 day move out notice. Well, I didn't get an email. He did sign and date the move out notice that my husband took over there.

So do we count today as the beginning of his 30 day notice, and therefore he didn't give a 30day notice to move out. Or do we just pretend like we got an email at the end of January and call it good.

How should we handle the security deposit. The likelihood is that he won't be getting the whole thing back anyway (kids colored on the wall and it was painted just before they moved in). But do we use part of his SD as rent until we get it re-rented, since we didn't get notice until 2/25 with a move out on 2/29?

I knew it had snowed in KS this winter.

Say as little as possible. Security deposit decisions get made AFTER the tenant is OUT.

First, in Kansas the notice has to be WRITTEN and signed. You received NO notice.

Unless your lease states differently, Kansas defines that 30-day from the "rent paying date". If that is not specified in your lease, Kansas says that is the 1st. So if your tenant gave you notice on Feb 25th, he owes rent [in full] for the month of March.

That deposit: Yes, deduct that rent. It is considered "damages" and lost rent is "damages". And don't forget to mail his statement within 30 days or you can plan on paying him one and a half times the deposit for failing to do so. --207.69.xxx.xx
