I am a tenant and I gave my 28 day notice of leave on the 5th of January. 28 days from the 5th of January is February 2nd. I plan on being completely out of the room by January 31st. My rent is $450, I am required to make 2 payments of $225 every month on the 5th and the 20th. Because the 28 day period extends into the month February am I responsible for paying the entire first half amount of February's rent ($225)? Or do I only pay for the 2 days in February? ($15.51 a day, so $30.03 for 2 days)

You are going to get four types of answers. Never heard of a 28 day period. Suggest you ask a Hawaii tenant group about this one.

1. What does your lease say?

2. In at least one state it is 30 days, any 30 days. Notify on the 2nd of one month, you are out by the 2nd of next month.

3. Most states have a 30 day period that coincides with the rental period. With a notice on January 5, it is not effective until the next rental period begins, which would be Feb1-29th, so you owe until February 29th because landlords do not rent by the day, only the month. If you occupy any portion of a month, you owe for that month.

4. What does your lease say? If you have a lease for a set period, usually a year, you owe for the entire period or until the landlord can re-rent. --151.213.x.xx

If what you are saying is the way your lease reads then...

Your payment on the twentyth would cover your rent through the fifth of February. I have never heard of a twenty-eight day notice. Rent is always pre-paid, meaning you pay ahead of time. You should really ask what your landlord says about this and consult someone familiar with your situation. --69.61.xxx.xxx

thank you all for responding. on my contract that i signed upon moving into the house, it states that before moving out i need to give a 28 day notice. i guess this is a Hawaii law. after reading over the tenant and renter obligations for hawaii on this website, it says that i am obigated to pay for as long as i stay. im not sure what to do. any more advice? --132.160.xx.xxx

Google for "landlord_tenant_HB_final.pdf", see page 12. It is pretty clear about your situation, assuming your contract is denoted as "month to month". You need to pay $30.03 --199.3.xxx.xxx
