State Specific Question About: OREGON (OR)

Just doing a double check. Oregon law and my lease state "Due on the 1st, late on the 5th." Holliday was the 1st, of course... Due on the 2nd, late on the 5th? 6th? 6th was Sunday, of course... Rent received on 7th.

My instinct is that it's late but wanted to double check with other Oregon LLs.

I think holidays and Sundays come into play for mailing, not for rent due dates. Not "Late on the 5th, except for January and July because of the holidays." --198.107.xx.xxx

The law is...

They have to have it in the mail by the 5th. Allow 3 days more for mailing.

You don't have to allow for mailing rent, but your office has to be open on saturday. None of your tenants would be able to mail a check, ever.

So, the check wasn't late.

In the name of government, they have made it possible for you to give a 72 hour notice of non payment on the 7th of the month. --24.21.xx.xx

My lease states that it's due on the 1st, late on the 2nd. I state it this way so the tenant understands that it is late if not paid on the 1st.

Sorry I was wrong. The rent is considered LATE on the fifth. Charge them a late fee if the envelope is postmarked the 5th.

90.260 Late rent payment charge or fee; restrictions; calculation. (1) A landlord may impose a late charge or fee, however designated, only if:

(a) The rent payment is not received by the fourth day of the weekly or monthly rental period for which rent is payable;
