What should I do with this tenant?
Let me explain what happened: Last summer, my tenant wanted to move out at end of our lease so she gave me a three month noitce and then I put the house up for rent. At last month, she changed her mind about moving out and asked me if I can renew which I gladly did because I did not find a new tenant at that point. Also, she said that she wants to adopt a 7 year old cat from a friend which is declawed and fixed.
I took the house off rental market and mailed her an lease extension agreement which also offered a 6 month lease for 25 bucks more along with a pet application which asked for a 200 bucks pet deposit.
On first month of the lease extension, I received rent in the same amount as if one year extension was signed (same amount as last year and she didnt want me to raise the rent). There was no signed lease extension agreement which she was supposed to return before end of our lease along with the pet application so I emailed her asking her to sing and return the forms. Finally, I got her letter which contained only the lease extension agreement with the 6/mo for extra 25 bucks checked off and signed. That means that she is short 25 bucks for this month so I emailed her again about the 25 bucks and cat. She said "I already sent the Dec rent but can mail extra 25 bucks if that is issue" and that she will get the cat amendment out to me.
I bet that most of you would not renew with this tenant since that she was late about 4 or 5 times (out of our 1 and half year lease total and paid 12 percent late fee every time). Since that she is sort 25 bucks for this month rent, do I charge her 12 percent late on full rent amount ($975) or just on unpaid portion only? ($25)
