As a small time landlord... I am always worried about my responsibilities + liability regarding snow & ice removal from common areas...
Does anyone know if there exists any specific laws or legal precedents regarding this topic?...

We have similar weather here in Minnesota. It is extremely unlikely that the WA legislature put in the time and effort to regulate LL, tenant salting issues. XXX is right, in general, the tenant is responsible for clearing snow and salting on SFHs and the LL is responsible for multi’s.
My opinion is that $15 to $20 in salt and sand per year is extremely inexpensive insurance on the off chance you do get hauled in for a legitimate slip and fall. Think about how petty and cheap you would look in front of a Judge or Jury trying to defend yourself against this.
Just save the receipt and write it off on your taxes like any other consumable.

My attorney stated very simply, if you end up in court the civil attorney would ask the judge or jury if it is prudent thinking to spread salt on common pavement when there is a danger of freezing ? Of course the answer is yes and YOU are now negligent. --69.207.x.xxx |
